Acceptance of Terms
By accessing or using Imagination Index ("the Service"), you agree to be bound by these Terms of Service. Creating an account or checking "I agree" to the terms at signup also constitutes acceptance. If you do not agree, please do not use the Service.
Service Description
Imagination Index provides an online assessment and related content to help you understand your imagination profile across multiple senses. We may update or discontinue features with reasonable notice where practicable.
Your Obligations
When using the Service, you agree to:
- Provide accurate information when creating an account.
- Keep your account credentials secure and not share them with others.
- Use the Service only for lawful purposes and in line with these terms.
- Not use the Service for illegal or unauthorized purposes.
- Respect the intellectual property rights of others and of Imagination Index.
- Not attempt to circumvent access controls, scrape data, or misuse the assessment or platform.
We reserve the right to suspend or terminate accounts that violate these terms.
Limitation of Liability
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, data, or business opportunity, arising from your use of or inability to use the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars (USD 100), whichever is greater. Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
Dispute Resolution
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Before bringing a formal legal action, you agree to try to resolve the dispute informally by contacting us first (see Contact below). If we cannot resolve the dispute within sixty (60) days, you may bring any dispute in the courts of the Province of Ontario, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms of Service from time to time. We will post the revised terms on this page and update the "Last updated" date. Material changes may be communicated by email or a notice in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms. If you do not agree to the new terms, please stop using the Service.
